The Minister acknowledged the concerns raised by Lee Anderson about HMOs and their impact on local communities. He explained that larger HMOs require planning permission, but smaller ones do not under national permitted development rights. Local authorities can introduce article 4 directions to remove these rights if needed to protect local amenity or well-being. The government is reviewing the current system to propose a more flexible approach for such directions. Additionally, all HMOs are subject to management regulations and licensing by local planning authorities where necessary. The government has provided funding to support enforcement responsibilities under the Renters’ Rights Act 2025. Regarding asylum accommodation in HMOs, Pennycook stated that the current Labour Government is working to end hotel use for asylum seekers and find a balance with dispersed accommodation options. He emphasised the existing powers local planning authorities have to limit the proliferation of HMOs and ensure they are safe and well-managed.
