The MP thanked constituents for raising the issue regarding excessive service charges at Port Marine, a development in Portishead. Residents have faced unreasonable variable and fixed rent charges imposed by management companies like FirstPort. This has resulted in difficulties for residents to get transparency on costs and legal redress. The situation affects around 1,000 constituents, both freeholders and leaseholders. In 2011, solicitors advised Crest Nicholson to reduce the fixed rent charge but this was not uniformly applied by FirstPort. Recently, under pressure, FirstPort agreed to keep the charge at £1 annually if residents enter into a deed of variation with legal fees charged at around £500 plus VAT. The MP called for reforms to address these issues and ensure fair treatment for leaseholders.

Government Response
The Minister responded by acknowledging the issues highlighted by the MP regarding Port Marine. He reiterated that leasehold reform is necessary due to the problems faced by residents, such as extortion and inefficiencies in the sector. The Leasehold and Freehold Reform Bill aims to better protect and empower leaseholders by making it easier for them to extend leases or buy freeholds, reducing enfranchisement costs, and improving transparency of service charges and fixed rent charges. The Minister committed to addressing variable service charge increases through standardised information requirements and legal challenges. For fixed rent charges, the Bill introduces a framework allowing residents to challenge excessive fees and hold management companies accountable through tribunals. He also mentioned considering further measures on this area and hoped for support from colleagues as the Bill progresses.
